These Terms of Use apply to general website access and shop purchases. They are separate from and operate alongside the Momentum³ Terms of Service, which governs the commercial relationship between THE LEAD ICON and customer organisations that purchase a Momentum³ System licence. Where you are both a website visitor and a Momentum³ customer, both documents apply to their respective subject matter.

THE LEAD ICON is a technology company that develops and operates AI-powered enterprise decision systems and business intelligence resources. Our products and systems include the Momentum³ System, an AI-powered enterprise decision operating system; the Architect Infinity System, the permanent embedded decision infrastructure available to Momentum³ customers; the Business Diagnostic System; Scenario Lab; and a curated library of business resources including playbooks, research publications, and editorial content. Where there is any inconsistency between a website description and the Momentum³ Terms of Service, the Terms of Service prevails.

The Architect Infinity System is the permanent embedded decision infrastructure available exclusively to Momentum³ customers following completion of the Momentum³ Cycle. It is not available for independent purchase through this website. Descriptions of the Architect Infinity System on this website are provided for general information purposes only and reflect our current design direction. The terms governing transition to the Architect Infinity System are set out in a separate transition agreement offered to eligible Momentum³ customers.

4.2 Products in Development

The Business Diagnostic System and Scenario Lab are available for independent purchase and are currently being developed and refined. They are also available as part of the Architect Infinity System for existing THE LEAD ICON customers.

THE LEAD ICON will communicate material updates to registered customers and interested parties by email as each system moves toward full availability.

Where you purchase access to a system in active development, THE LEAD ICON is fully committed to delivering the system and will keep you informed of progress throughout. In the event of any material change to the scope or timeline of a system, registered customers will be notified and offered appropriate options. The authoritative terms governing any such purchase are set out in the applicable purchase agreement executed between the parties.

5. Shop | Purchase of Digital Products

5.1 Digital Products

THE LEAD ICON offers digital products for purchase through its website, including business playbooks, research publications, editorial guides, and other business resources. All shop purchases are processed by Stripe, Inc. We do not collect or store payment credentials. By purchasing a digital product, you agree to these Terms of Use and to Stripe’s terms of service.

Digital products are delivered by download link or electronic access immediately upon confirmation of successful payment. It is your responsibility to ensure that your device and software are compatible with the digital product format before purchase. THE LEAD ICON is not responsible for technical issues arising from incompatibility between the digital product and your device or software.

5.3 Licence for Digital Products

Upon purchase of a digital product, THE LEAD ICON grants you a limited, non-exclusive, non-transferable, personal licence to access and use the digital product for your own internal business or personal purposes. You may not share, redistribute, reproduce, resell, sublicence, or commercially exploit any digital product purchased from this website. You may not use digital product content to train, develop, or improve any AI model or automated system.

5.4 Refund Policy for Digital Products

​

Digital products are delivered immediately upon purchase and cannot be returned once accessed or downloaded. Accordingly, all sales of digital products are final and no refund is available once the product has been accessed or the download link has been used.

Where a digital product is defective, corrupted, or materially different from its description at the time of purchase, you may request a replacement or refund by contacting contact@theleadicon.com within 7 days of purchase with a description of the defect. THE LEAD ICON will assess the request and provide a remedy at its discretion, which may include a replacement file, store credit, or refund.

Nothing in this refund policy excludes, restricts, or modifies any right or remedy available to you under applicable consumer protection law that cannot lawfully be excluded.

5.5 Pricing

All prices displayed on the website are in United States Dollars unless otherwise stated. Prices are exclusive of applicable taxes. INTERNAL NOTE | FOR LEGAL REVIEW

Section 4.2 on products in development requires review by commercial counsel before publication. The commitment language has been calibrated to be commercially strong while legally defensible but should be reviewed in the context of applicable consumer protection law in each target market. Section 5.4 digital product refund policy should be reviewed against applicable consumer guarantee provisions. The AI training prohibition in Section 2.3 should be reviewed by IP counsel for cross-jurisdictional enforceability. Architect Infinity is correctly positioned as a customer-only transition product and does not appear as a purchasable website product. Publish in website footer alongside Privacy Policy, Cookie Policy, and Acceptable Use Policy before launch.
